TERMS AND CONDITIONS

RULES AND REGULATIONS

After placing an order, you will receive an email from us acknowledging that we have received your order for the goods and the delivery service you have required. This does not mean that your order has been accepted. Your order constitutes an offer to Activ Cycles to buy goods. All orders are subject to acceptance by us. Acceptance is confirmed by our sending an email that confirms dispatch by the delivery service provider. The contract between you and Activ Cycles will only be formed when we send you this dispatch confirmation.

The contract will relate only to those Goods whose dispatch we have confirmed in the dispatch confirmation. We will not be obliged to supply any other goods which may have been part of your order until the dispatch of such goods has been confirmed in a separate dispatch confirmation.

We reserve the right to cancel the contract between us if:

  1. We have insufficient stock to deliver the Goods you have ordered;
  2. The delivery service provider does not deliver to your area
  3. One or more of the Goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers, or we have reason to suspect that there is a risk of a fraudulent transaction.

Please note that payment shall be taken in full for orders placed online at the time of the order.

Your rights are set out in the Distance Selling Regulations, which includes your right to cancel. You have the right to return goods for a full refund for seven days from when they are delivered. To return any goods, please follow our returns procedure laid out below.

Please note that goods returned under these regulations should be fit for resale, namely:

  • Clothing should be unworn apart from what is reasonable to confirm fit.
  • Goods should whenever possible be returned in their original packaging.
  • Goods should show no signs of wear/use.

FAULTY GOODS

In the event of goods which you have bought from us, proving to be faulty, please follow the returns procedure laid out below. In the first 12 months from the date of the purchase, we will at our discretion exchange or repair faulty goods. You must return goods to us and we may at our discretion return goods to the manufacturer for report and/or for product improvement. Some goods may offer a longer warranty. Please note that any warranty over 12 months is pure with the manufacturer and you should contact them directly.

Goods will not be considered faulty if they have been used for a purpose for which they are unsuitable, failed to be maintained reasonably, modified or otherwise treated unreasonably.

Please note that many items sold for "competition" or "racing" purposes have been developed to give maximum performance. As such, they may offer a considerably reduced service life compared to that expected of typical consumer equipment. They may also endure or cause excessive stresses to themselves or related components, reducing life expectancy. Wear in this manner will not be considered faulty.

RETURNS POLICY

Subject to the terms set out below we are happy to offer a refund or exchange on all goods except goods which are special orders or nutrition products, and where we have expressly advised you that there is no right to return the goods ordered (save in the event the goods are faulty) provided the goods are returned to us within 14 days of delivery to you.

If you return goods to us and request a different size or alternative product we will send it out free of charge (subject to stock availability). If you require a refund (or the replacement item is not in stock) we aim to process refunds within 7 days of receipt of the goods. It is your responsibility to ensure that the item is returned to us safely and securely and in saleable condition.

Refunds will be processed using the same method of payment used for the original purchase. Due to the high incidence of fraud, we regret that we are unable to offer any refund without a valid receipt/delivery note.

If the product is faulty or wrong due to a mistake on our part then we will send out replacements free of charge and refund you the cost of sending the goods back to us. For all goods returned please include a letter giving details along with a copy of the original receipt. Returned goods must be unused and with all appropriate packaging and labelling intact.

Products which are out of stock in-store but have to be ordered for shipping from our suppliers (otherwise known as special orders) do not fall under our returns or refunds policy. Due to the shipping cost of ordering the product, we will not accept these for returns or refunds.

Your rights to return goods are protected under the Consumer Protection (Distance Selling) Regulations 2000 which can be found at theConsumer Protection (Distance Selling) Regulations 2000 (legislation.gov.uk).

All information on this website is believed to be correct to the best of our ability. Much of the information is based on that supplied by the manufacturers, due to ongoing improvements products may vary slightly. The pictures provided are for guidance purposes only. Due to the variation in computer equipment, colour images may not be reproduced accurately.

FITNESS FOR PURPOSE

It is your responsibility to ensure that the parts you purchase are suitable for the use to which you wish to put them. If you require guidance, please contact us before purchase, and we will be pleased to advise on the use of our range of products. This advice should not be taken to overrule any specifications or restrictions placed on the products by the manufacturer.

LIABILITY POLICY

We shall not be liable for incidental or consequential damages or expenses. This includes but is not limited to, damage to property, lost income, profits, economic or commercial losses and third-party claims.

We will do our best to get all orders despatched as quickly as possible. We have no liability to you for any delay in the delivery of the products ordered. You have the right to cancel delayed orders at any time and get a refund before the item is despatched.
